1. Description of Service

Palabrium is a vocabulary learning tool designed to help users capture words and review them using AI-generated study cards and spaced repetition. The app offers free (anonymous and signed-in) tiers, as well as a premium "Pro" subscription.

2. Accounts and Registration

You may use the app anonymously for limited captures. To access higher limits or sync across devices, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Subscriptions and Payments

• Pro Tier: Palabrium offers auto-renewing premium subscriptions ("Pro") that unlock higher daily AI capture limits and rich context sections.
• Processing: All payments are handled by the Apple App Store or Google Play Store. We use RevenueCat to facilitate these transactions.
• Renewals and Cancellations: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You must manage or cancel your subscriptions directly through your Apple ID or Google Play account settings.
• Refunds: Any requests for refunds must be directed to Apple or Google, as their respective policies govern the transactions.

4. User-Generated Content and Shared Dictionary

You may input text and edit study cards within Palabrium. You retain ownership of the original text you input.

By entering content, you grant Palabrium a license to store and display that content within your account. Additionally, you grant us the right to process your captured terms through AI providers to generate derivative dictionary content (such as translations, definitions, and audio pronunciations). You agree that your captured term text and this AI-generated derivative content may be stored in a shared global database and made available to other users who capture the same terms. This shared cache is stored without your account identifiers and is not linked to your profile.

Because raw input text is processed by AI to generate this shared content, you agree not to input any sensitive personal information, private communications, or copyrighted text not belonging to you. Palabrium is not responsible or liable for any inappropriate or inaccurate text you choose to input.

5. Intellectual Property

The Palabrium application, its original design, features, functionality, and branding are owned by Sergey Kolesnikov and are protected by international copyright, trademark, and other intellectual property laws.

6. Disclaimer of Warranties

Palabrium is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the app will be uninterrupted, error-free, or completely secure. We make no guarantees regarding the absolute accuracy of the AI-generated translations, definitions, or context.

7. Limitation of Liability

To the maximum extent permitted by law, Sergey Kolesnikov shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of or inability to use Palabrium.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Argentina. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the Autonomous City of Buenos Aires, Argentina.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Effective Date" at the top of these Terms and, where appropriate, providing an in-app notice. Continued use of the app after any changes constitutes your acceptance of the new Terms.
